How we use your information
- To underwrite, fund, and service your loan
- To meet federal and state legal and regulatory obligations, including adverse action notices under ECOA and credit bureau reporting under FCRA
- To prevent fraud and verify identity
- To send you transaction notices, statements, and reminders you have consented to receive electronically
- To respond to your enquiries and complaints
We do not use your personal information for automated decision-making that produces legal effects beyond the credit decision itself.
Who we share information with
- Credit bureaus. We report account status monthly to the major consumer reporting agencies as required by the Fair Credit Reporting Act.
- Identity verification providers. To confirm your identity as required before funding.
- Payment processors. To fund your loan and collect payments via ACH.
- Regulators and law enforcement. Where required by law or valid legal process.
- Service providers. Contractors who help us deliver the service, under confidentiality obligations that prohibit using your data for any other purpose.
We do not sell your personal information to any third party, and we do not share it for marketing purposes. Our reasoning is explained on how we make money.
Gramm-Leach-Bliley Act notice
As a financial institution we are governed by the federal Gramm-Leach-Bliley Act (GLBA). We limit sharing of your nonpublic personal information to what the law requires and to what is necessary to deliver and service your loan. How long we keep your information
We retain your information for the period required by applicable consumer lending law, generally five to seven years from the date the account is closed, and then securely destroy it.
Security
All data in transit is encrypted using TLS. Personal and financial data is encrypted at rest. Access is restricted to staff with a specific business need. We maintain an information security programme that meets the Safeguards Rule under GLBA. See the security page for more detail.
Your rights
Depending on your state of residence you may have rights to:
- Know what personal information we hold about you
- Request correction of inaccurate information
- Request deletion, subject to our legal retention obligations
- Opt out of certain sharing
- Obtain a free copy of any consumer report we relied on in an adverse credit decision, within 60 days of the decision
